  A Look at Arbitration, Mediation and Litigation
Alternative dispute resolution or 'ADR' generally encompasses two distinct forms of dispute resolution: arbitration and mediation. The resolution of civil disputes has undergone a radical transformation in the last decade with the increasing use and popularity of alternative dispute resolution options, such as arbitration and mediation, instead of trials. Virtually any legal dispute that might arise between two parties may be resolved by arbitration, so long as they have entered into a binding arbitration agreement. Arbitration allows two parties to designate that their dispute will be resolved by a neutral decision maker or a panel of decision-makers other than a judge employed by a public body.
